Conditions applicable to any order placed with Daram Tech Ltd via www.hassod.eu.
This English text is a courtesy translation of the French Terms and Conditions of Sale. In the event of any discrepancy or ambiguity, the French version prevails and is the sole binding text.
These Terms and Conditions of Sale (hereinafter the “T&Cs”) govern the contractual relations between:
Daram Tech Ltd (hereinafter “the Seller” or “HAssOD”),
Limited liability company under Israeli law, registered under number 515621522,
whose registered office is at Yossef Lapid 3, Netanya, Israel,
represented by David Itah, President,
contactable at contact@hassod.eu,
and any natural or legal person (hereinafter “the Buyer” or “the Client”) wishing to acquire a product from the Seller via www.hassod.eu.
These T&Cs define the conditions under which the Seller supplies Buyers with Products ordered on the Site.
Any Order placed with the Seller implies the Buyer’s full and unreserved acceptance of these T&Cs. Acceptance is evidenced by signature of the quotation or by full payment referred to in article 6.
The Seller reserves the right to modify these T&Cs at any time. The T&Cs applicable are those in force on the date of the Order.
HAssOD Products are hand-made jewellery creations made to order, as unique pieces or limited editions depending on the model. Essential characteristics (materials, stones, finishes, dimensions, weight, engraving of the kabbalistic Name) are described on the Site and confirmed in the quotation sent to the Buyer.
Given the artisanal nature of manufacture, the Buyer acknowledges and accepts that slight variations may exist between visuals presented on the Site and the piece delivered (grain of the case wood, intensity of a stone, micro-variations of engraving). Such variations cannot constitute a lack of conformity.
Each piece delivered is accompanied by a numbered certificate of authenticity issued by the Seller.
Any Order proceeds as follows:
The Seller reserves the right to refuse any Order for a legitimate reason, notably where a request is contrary to the values of the house, materials are unavailable, or the requested Name–model combination is manifestly incoherent. If refusal follows payment, the amount paid is refunded in full within 14 days.
Prices indicated on the Site are indicative prices expressed in US dollars (USD), shown without decimals and rounded up to the next whole dollar. The final price is set in the quotation sent to the Buyer, according to the specifications retained, the price of raw materials (gold, precious stones) on the quotation date, and applicable delivery charges.
Prices are exclusive of customs duties and import taxes that may apply in the destination country, which remain solely at the Buyer’s charge.
Full payment is due at order, after acceptance of the quotation, including separately stated delivery charges. At payment, the Buyer may choose another supported fiat currency offered by the Seller or its payment provider; the converted amount and applicable exchange rate are disclosed before confirmation. Cryptocurrency payments are not accepted. Payment is made by secure international bank transfer or by the payment method stated in the quotation.
Bank details are communicated in the quotation. No payment is collected directly via the Site. Manufacture begins after full payment is received.
Manufacture times vary by model ordered:
Timescales run from the date of clearing of full payment and are indicative. Any overrun gives rise to indemnity only under the conditions provided by the law applicable at the consumer’s place of residence.
The Seller delivers to the following zones: European Union, Switzerland, United Kingdom, United States, Canada, Israel. Delivery outside these zones is studied case by case.
Shipment is by secure transport with declared-value insurance and signature on delivery. Delivery charges are stated in the quotation and billed at actual cost.
The Buyer must check the condition of the parcel on receipt and report any anomaly (damaged packaging, broken seal) to the carrier and the Seller within 3 business days of delivery.
Transfer of title in the piece to the Buyer occurs upon full payment of the price.
Transfer of risk (loss, theft, damage) occurs upon effective delivery of the piece to the Buyer or to a third party designated by them (place of delivery).
HAssOD pieces being made to measure and bearing the engraving of a kabbalistic Name chosen by the Buyer (and possibly initials, a date or a personal word), they fall within the category of goods made to the consumer’s specifications or clearly personalised.
Accordingly, pursuant to Article 16(c) of Directive 2011/83/EU of the European Parliament and of the Council on consumer rights (transposed notably in Article L221-28, 3° of the French Consumer Code), the 14-day right of withdrawal does not apply to Orders placed with the Seller.
This exception does not affect the Buyer’s rights as to the legal guarantee of conformity and hidden defects (article 10).
The Seller warrants conformity of the Products to the specifications agreed in the quotation and to their description on the Site. In the event of a proven lack of conformity, a consumer Buyer residing in the European Union benefits from the legal guarantees provided by their national legislation (notably, in France, Articles L217-3 et seq. of the Consumer Code), without prejudice to guarantees offered by Israeli law.
The Seller guarantees for life the authenticity of each HAssOD piece: precious materials (18-carat gold, 925 silver, certified stones), deep engraving of the Hebrew Name, engraved serial number.
The Seller offers a paid service of re-engraving, stone re-setting, polishing and restoration of HAssOD pieces beyond the warranty. Conditions and tariffs are communicated on request.
Any claim, after-sales request or dispute may be addressed to the Seller at contact@hassod.eu. The Seller undertakes to provide a reasoned reply to the Buyer within 5 business days.
The Seller’s liability cannot be engaged for non-performance of all or part of its obligations resulting from a force majeure event as defined by the case law of the competent courts, including notably: armed conflicts, civil unrest, natural disasters, pandemics, general strikes, lasting disruptions of the supply chain for precious materials or certified stones.
Personal data communicated by the Buyer in connection with their Order is processed in accordance with the General Data Protection Regulation (GDPR) and the Site’s Privacy Policy.
Purchase of an HAssOD piece confers on the Buyer no intellectual-property right in the HAssOD trademark, its models, graphic identity or creations. Any reproduction, copy or imitation, in whole or in part, is strictly prohibited and constitutes infringement.
These T&Cs are governed by Israeli law, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods.
However, where the Buyer acts as a consumer and resides in a Member State of the European Union, they also benefit from the protection afforded by the mandatory provisions of the law of their country of residence, pursuant to Regulation (EC) No 593/2008 (Rome I).
In the event of a dispute, the Buyer is invited to contact the Seller first at contact@hassod.eu in order to seek an amicable solution.
Failing amicable resolution, any dispute shall be brought before the competent courts of Tel Aviv-Jaffa, Israel. The consumer Buyer residing in the European Union nevertheless retains the ability to bring proceedings before the courts of their place of residence, pursuant to Regulation (EU) No 1215/2012.
